Terms of Service

By creating an account, deploying an application, or otherwise using ViibeStack (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" refers to that entity. If you do not agree to these Terms, do not use the Service.

ViibeStack is a platform for describing, generating, deploying, and operating custom software applications, including AI-assisted app generation, a template marketplace, hosting on ViibeStack infrastructure, per-app end-user accounts, and related tools (APIs, MCP servers, integrations, and a CLI). We may add, change, or remove features of the Service at any time. We'll try to give reasonable notice of material changes that reduce functionality you're actively relying on.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create a ViibeStack account. The Service is not directed at children under 13, and we do not knowingly collect personal information from children under 13. You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@viibestack.ai if you suspect unauthorized access. If your application uses ViibeStack's app-auth feature, the same eligibility and security responsibilities extend to how you configure and operate accounts for your own application's end users.

Paid plans are billed in advance on a recurring basis (monthly or annually, as selected) through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method for all applicable fees, including recurring charges until you cancel. Fees are generally non-refundable except where required by law or as we expressly state otherwise. You're responsible for any applicable taxes, which may be added to your invoice. We may change our pricing on a going-forward basis with notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing. If you enable pricing on your own application and accept payments from your own customers through ViibeStack's payment infrastructure, ViibeStack retains a commission on those transactions as disclosed to you at the time you enable that feature.

You agree not to use the Service to: violate any applicable law or regulation; infringe the intellectual property or privacy rights of others; upload or generate malicious code, malware, or content designed to disrupt or gain unauthorized access to any system; send unsolicited bulk communications; scrape, reverse-engineer, or attempt to circumvent rate limits or security controls of the Service; or resell raw access to the Service without our prior written consent. We may suspend or terminate access for violations of this section, with or without notice, depending on severity.

You retain ownership of the content, data, and application configurations you provide to or generate through the Service ("Your Content"). You grant ViibeStack a limited license to host, store, process, and display Your Content solely as necessary to provide and operate the Service. As between you and ViibeStack, you own the specific application you generate or upload, subject to ViibeStack's underlying rights in the platform, templates, shared component libraries, and infrastructure that power it. You're responsible for ensuring Your Content and the applications you build don't infringe third-party rights or violate applicable law. You're solely responsible for the data collected, processed, or stored by applications you deploy, including any obligations to your own end users under privacy or consumer-protection law.

Portions of the Service use artificial intelligence, including third-party AI models, to generate or modify application code and content based on your instructions. AI-generated output may contain errors, and we don't guarantee it will be accurate, secure, or fit for any particular purpose. You're responsible for reviewing and testing any AI-generated code or content before relying on it, particularly before using it in a production application or one that handles sensitive data.

The Service relies on and integrates with third-party providers, including cloud infrastructure, database hosting, payment processing, email/SMS delivery, and AI model providers. Your use of features backed by these providers is also subject to their applicable terms, and we're not responsible for their acts, omissions, or downtime.

The Service, including its underlying software, design, templates, and the ViibeStack name and logo, is owned by ViibeStack and protected by intellectual property laws. Except for the limited rights expressly granted to you in these Terms, we reserve all rights in the Service.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay applicable fees, or if required by law. Upon termination, your right to access the Service ends, and we may delete Your Content and deployed applications after a reasonable grace period. You're responsible for exporting any data you wish to retain before termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIIBESTACK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. VIIBESTACK'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO VIIBESTACK IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold ViibeStack harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, the applications you build, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. You and ViibeStack agree that the exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or the Service will be the state or federal courts located in North Carolina, and both parties consent to personal jurisdiction there.

We may update these Terms from time to time. If we make material changes, we'll provide reasonable notice, such as by posting the updated Terms on this page with a new effective date or by emailing the address on your account. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision isn't a waiver of it. You may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ViibeStack regarding the Service.
